Desert Scouts™ Representative(s) Policies and Guidelines (Terms of Service) 
 
All Representatives of Desert Scouts acknowledge and agree to the Desert Scouts Policies and Terms and Conditions upon entering the Desert Scouts Platform. All Desert Scouts Policies and Terms and Conditions are posted on the Representative’s dashboard for review, and can be requested through Desert Scouts Operations (operations@desertscouts.net) at any time. 
 
Desert Scouts consists of both Independent Contractors and Employees. All Desert Scouts Policies and Terms and Conditions apply to both Independent Contractors and Employees. 
 
Both titles (Independent Contractors and Employees) and descriptions will apply to, and be known as “Desert Scouts Representative” or “Desert Scouts Representatives” throughout Policies and Terms of Service Agreements. 
 
All Representatives are considered Independent Contractors, unless there is a current, signed Official Desert Scouts Employee Contract which states otherwise. It is the responsibility of the Desert Scouts Representative to understand their position with the Organization.

Initial Athlete Contact: 

  • Initial Contact must be made with an athlete/parent/legal guardian, by their evaluator within their first 48 hours on the platform. The initial meeting with an athlete will occur after they have booked for their Initial B.A.S.E.™ Assessment and/or Athlete Performance Assessment (Ex: On-Field, On-Court, On-Ice Assessment) within the first 30 days. (Athletes cannot participate in testing, strength and conditioning programming, performance assessments or training prior to receiving the Desert Scouts B.A.S.E. Assessments / Desert Scouts Corrective Measures programming. *All assessment data/scores must be entered exclusively on the Desert Scouts Platform
  • An athlete who has been assigned to an Athlete Evaluator / Desert Scouts Network for more than seven (7) days, without an Initial Contact or Event/Assessment booking, will be transferred to the next nearest Certified Evaluator.
  • The expectation at Desert Scouts™ is that every athlete has a great experience with transparent and honest communication. If the Evaluator cannot reach out to the athlete/parent/guardian within 48 hours, must notify their State/Regional Evaluator, so that they can assist immediately. Multiple violations with regards to lack of communication may result in the termination of the Representative, their Representative Agreement, and voids all return policies included in this document.
  • Each Athlete should have their first B.A.S.E. Assessment, Strength and Conditioning Programming Assignment, and/or Athlete Performance Assessment completed, with scores and feedback within their first 30 days on the platform.

Athlete Facing Guidelines: 

  • Desert Scouts™ Representatives must arrive at least 30 minutes prior to scheduled assessment. (Setup / Organize)
  • Desert Scouts™ Representatives must immediately identify themselves by Name, Desert Scouts ID Number, and show Identification (Proof of Certification | Liability Insurance) if requested.
 Attire: 
  • Proper attire is required for all Athlete-facing activities. Desert Scouts™ apparel is expected. Desert Scouts Representatives will be rated by their athletes and their families. Showing up in attire that is not considered clean or tidy will reflect negatively on the Representative, the Desert Scouts platform, and the entire Organization.
Additional acceptable attire: 
  • Shorts; Primarily Orange, Navy, Grey, White, or Khaki
  • Pants; Black, Navy, Khaki
  • Shirts; Primarily Orange, Navy, Grey, or White
  • Hats; Sports specific hats
Unacceptable attire: 
  • Apparel with inappropriate words or images
  • Apparel with another individual’s name on it
  • Featuring alcohol, or drug references / paraphernalia 
  • Other sports platforms that are considered in competition with Desert Scouts™
Equipment: 
  • Desert Scouts™ Evaluator Bag / Equipment or individually purchased 4 and 6 LB medicine balls, cones, stop watch, and measuring tape in order to complete the B.A.S.E. Assessment™.
  • Desert Scouts™ Evaluators need to provide baseballs, (Radar Gun or Pocket Radar), (Diamond Kinetics, Rapsodo, Trackman, Or Hittrax) in order to complete Assessments.
  • All equipment should be fully functioning and up to Desert  Scouts™ Standards.
  • Sports Specific Technology needs to be up to date and fully charged before each assessment and Athlete Performance Assessment.

  • DISCORD™ is the official communication platform for the entire Desert Scouts™ network.  
  • Please use DISCORD™ for constructive conversation. 

  • If there is a personal question or concern, please do not use any of the public DISCORD™ channels to voice concerns. Please direct general comments and/or concerns directly to the Desert Scouts Support Team - support@desertscouts.net
  • All URGENT/IMMEDIATE concerns should be directed to Desert Scouts CEO – Dr. Brian "Link" Lindquist b.lindquistdesertscouts.net
  • Anyone misusing DISCORD™, or any of the official Desert Scouts communication channels, will receive one (1) warning for negative conduct. Multiple violations may result in the termination of the Representative, their Representative Agreement, and voids all return policies included in this document.

  • All initial communications and requests with Desert Scouts™ Investment Partners, Board of Directors, Advisory Board or Directors must go through Desert Scouts™ Leadership. Desert Scouts Representatives can contact Desert Scouts CEO – Dr. Brian "Link" Lindquist through DISCORD, or email support@desertscouts.net to help facilitate any needs or concerns.

  • All communications with Desert Scouts™ Investment Partners, Board of Directors, Advisory Board or Directors must take place on the Official Desert Scouts™ DISCORD Application, through the Direct Message feature.

Cell Phone Policy: 
  • Desert Scouts™ Representatives are to avoid cell phone use during Evaluations, Assessments, Trainings, Camps and Clinics. Unless for capturing assessment video content, or in the case of an emergency. 
  • Improper use of cell phones may result in disciplinary action. Continued use of cell phones at inappropriate times or in ways that distract from work is a violation of Desert Scouts company policies.
  • Cell phone usage for illegal or dangerous activity, for purposes of harassment, or in ways that violate the company confidentiality policy may result in the termination of the Representative and their Licensing Agreement.

Partnership / Joint Venture (JV) Agreements: 

  All partnerships associated with the Desert Scouts™ platform and brand must be approved by Desert Scouts™ leadership. 

   Desert Scouts Representative Access: 
  • All Representatives must sign the most up to date Desert Scouts™ Representative Agreement, along with the most up to date Non-Disclosure Agreement through Desert Scouts™ in order to continue to access the Desert Scouts™ Platform, and its Content. 
  • Any Desert Scouts™ Representative who does not sign the most up to date Desert Scouts™ Representative Agreement, along with the most up to date Non-Disclosure Agreement (NDA) through Desert Scouts™ Non-Disclosure Agreement, will not be allowed to start, continue, or complete any of the Desert Scouts Trainings, Programming or Certification programs, nor be allowed to work with athletes, or on the Desert Scouts™ Platform. 
  • Representatives of Desert Scouts™ may be required to sign an updated Representative Agreement, Addendum, and / or NDA, when new programs / offers are introduced to the Desert Scouts™ platform, which require outlines added to all current Agreements.

DESERT SCOUTS - Social Media Conduct of Business and Online Presence Conduct of Business

Desert Scouts™ understands and respects our Representative’s rights to freedom of speech in relation to using Social Media. Social Media is a place where the world exchanges information, opinions and experiences to learn, develop and entertain. Whether an Desert Scouts Representative is posting on behalf of Desert Scouts™, in relation to Desert Scouts™, or using their own personal accounts, they should remain productive and avoid possibly damaging the Desert Scouts™ organization in any way. This policy provides practical expectations to avoid issues which may arise due to careless use of social media in a way that not only hurts the Representative and the Desert Scouts™ Organization, but also their fellow Desert Scouts™ Representatives.

Scope:

We expect all Representatives of Desert Scouts™ to follow these policies.

“Social Media” refers to a variety of online applications and communities, such as blogs, social networks, chat rooms and forums – including, but not limited to platforms such as Facebook, Twitter, LinkedIn, YouTube, TikTok, Etc.

These policies are built around appropriately representing Desert Scouts™ as an organization, the Desert Scouts brand, the Desert Scouts™ official partners, Desert Scouts™ Board of Directors and Advisors, as well as all Desert Scouts™ Representatives.

Policies:

Using Social Media: 

We permit our Representatives to publicly display their association with the Desert Scouts™ brand, in ways such as posting Desert Scouts™ as their work status, posting or sharing Desert Scouts™ branded or related content, which insinuates an affiliation with Desert Scouts™ and/or its partners.
  
With regards to any affiliation with Desert Scouts™ that is publicly or privately displayed through any Social Media outlet, Desert Scouts™ expects their representatives to act responsibly and ensure that the Desert Scouts™ Organization, Product and Brand are not adversely affected.
  
Desert Scouts™ expects their representatives to be aware, careful, and respectful while posting on Social Media. We expect Desert Scouts Representatives to adhere to confidentiality policies at all times. We also caution our representatives to avoid violating anti-harassment policies or posting anything that might make collaboration with colleagues more difficult (Ex: hate speech, vulgarities, etc.) 

 
Expectation while using Social Media

 In the event that any of our Representatives choose to disregard using caution when posting to Social Media, while risking possible damage to the reputation of Desert Scouts, its partners, representatives, and associates, we require that they:
 
● Ensure others know that their personal account or statements do not represent Area
Scouts, the Desert Scouts brand, the Desert Scouts™ official partners, as well as all Area
Scouts Representatives. (Disclaimer is recommended)
 
● State or imply that their personal opinions and content are not authorized or endorsed by Desert Scouts™, the Desert Scouts™ brand, the Desert Scouts™ official partners, as well as all Desert Scouts™ Representatives. (Disclaimer is recommended) 
 
 ● Remove all data which may insinuate an association to Desert Scouts, the Desert Scouts
  brand, the Desert Scouts™ official partners, as well as all Desert Scouts Representatives.

  ● Avoid sharing intellectual property, including, but not limited to trademarks, logos, data or content associated with Desert Scouts™, the Desert Scouts™ brand, the Desert Scouts™ official partners, as well as all Desert Scouts™ Representatives. (Disclaimer is recommended) Desert Scouts™ Confidentiality policies and laws always apply to intellectual property belonging to Desert Scouts™ and the Desert Scouts™ official partners.
 
 Defamatory, offensive or derogatory content is to be considered a direct violation of the Desert Scouts™ company’s anti-harassment policies, if directed towards colleagues, clients or partners, it is ground for immediate removal from the organization.

  Representing DESERT SCOUTS™

 Representing the Desert Scouts organization through Social Media or speaking on Desert
 Scouts behalf, we expect that all Desert Scouts Representatives act carefully and responsibly to protect the Desert Scouts image and reputation. they should:

 
● Be respectful, polite and patient, when engaging in conversations. They should be
extra careful when making declarations or promises towards Desert Scouts potential
customers and/or partners.
● Avoid speaking on matters outside of their field of expertise when possible. Everyone
should be careful not to answer questions or make statements that fall under somebody
else’s responsibility.
● Follow and observe laws on copyright, trademarks, plagiarism and fair use.
● Inform Desert Scouts™ Public Relations Department
(publicrelations@desertscouts.net) when they are about to share any major-impact
content, or if they have any questions or concerns regarding policies.
● Never post discriminatory, offensive or libelous content and commentary.
● Correct or remove any misleading or false content immediately. 
 
Disciplinary Consequences
Desert Scouts™ officially contracted a Social Media monitoring company, to monitor all Social Media postings related to, or associated with Desert Scouts™.
 
We reserve the right to take appropriate disciplinary action leading up to and including the possible termination of the Representative and their Licensing Agreement in the event that a representative chooses not follow Desert Scouts™ policy guidelines.
 
If any Desert Scouts Representative violates this policy inadvertently, they may receive a written warning to comply after such event, or stricter disciplinary actions may apply. 
 
Misrepresentation 
 
ANY REPRESENTATIVE OF DESERT SCOUTS™ WHO MISREPRESENTS THEMSELVES AS A PARTNER, REPRESENTATIVE OF UPPER MANAGEMENT, DIRECTOR, OR REPRESENTATIVE, WITHOUT MAINTAINING SAID STATUS, FOR PERSONAL OR MONETARY GAIN, OR NEGOTIATES UNAUTHORIZED VERBAL OR WRITTEN CONTRACTS WITH ASSOCIATION TO DESERT SCOUTS™, IS IN DIRECT VIOLATION OF DESERT SCOUTS POLICIES AND TERMS AND CONDITIONS, AND WILL RESULT IN THE TERMINATION OF THE REPRESENTATIVE, THEIR REPRESENTATIVE AGREEMENT, AND VOIDS ALL RETURN POLICIES INCLUDED IN THIS DOCUMENT. 
 
 Desert Scouts™ Policy for Working with Minors 
Abuse/Molestation Risk Management Program 

 The Protection and well-being of children under the age of 18 is of the highest priority to Desert Scouts™, which is committed to providing the safest and most secure environment for minors. This policy applies to all activities involving minors operating under the authority and direction of Desert Scouts™. 
 
 
 DEFINITIONS:
 “Minor” for purposes of this policy, means any person under the age of 18 who is participating in an Desert Scouts™ Activity. 
 
“Authorized Adults” for purposes of this policy means all individuals, ages 18 and over, paid or unpaid who instruct, supervise, chaperone or otherwise oversee Minors in connection with Desert Scouts™ Activities. 
 
Desert Scouts has adopted the following policies and this document will also serve as our adult Desert Scouts Representative educational training program: 
 
Criminal Background Checks Criminal background checks should be run with a third-party vendor on all paid and volunteer Desert Scouts Representative with access to youth. At a minimum, the criminal background check should pull records from all 50 states to include the National Criminal Database and the National Sex Offender registry. 
 
Any background check that indicates that a potential Desert Scouts Representative is unfit to work with youth should result in disqualification of such Desert Scouts Representative. 
 
Prior to running background checks, the following steps* should be taken: 
 
-        All prospective Desert Scouts Representative should complete a written application to include a question about whether the applicant has ever had any prior criminal convictions or is pending any current investigations and a consent provision to run a background check. 
 
-        Disqualification criteria should be adopted and published. 
 
-        The confidentiality of records should be protected and access should be limited to those on a “need to know” basis. 
 
-        Before an adverse action is taken against an applicant, our organization should comply with all federal and state laws governing background checks such as the Fair Credit Reporting Act and assistance should be requested from our background check vendor as regards required applicant notifications. 
 
Recognizing Grooming 
 
Grooming is the process by which sexual predators pave the way for sexual abuse by gradually gaining the trust of and conditioning of minors, parents, and administrators. The steps in the grooming process are as follows: 
-        Identify a vulnerable child whose needs are not being met such as lack of attention by parents, lack of spending money, etc. 
-        Fill the missing needs of the child by providing attention, transportation, help with homework, special favors, confiding in secrets, spending money, gifts, etc. to create a "special bond". 
-        Gain trust of family by spending disproportionate amount of time with them. 
-        Isolate the victim to create one on one opportunities. 
-        Gradually use boundary invasions that start off with inappropriate electronic communications and photo sharing, tickling, wrestling, massages, alcohol, drugs, pornography, etc. that lead to nudity and sexual activity. 
-        Maintain control and silence with threats of fear and shame. 
 
 
Policies to Protect Against Misconduct 
 
· All forms of abuse including sexual, physical, emotional, harassment, bullying, and hazing are prohibited. 
· Prohibited sexual abuse physical acts include genital contact whether or not either party is clothed; fondling of a participant's breast or buttocks; sexual penetration; sexual assault, exchange of a reward in sport for sexual favors; lingering or repeated embrace that goes beyond acceptable physical touch; tickling, wrestling, or massage; and continued physical contact that makes a participant uncomfortable. 
· Prohibited sexual abuse verbal acts include making sexually oriented comments, jokes and innuendo; Desert Scouts Representative discussing his or her sex life with participant; asking about a participant's sex life; requesting or sending a nude or partial dress photo; exposing participants to pornographic material; voyeurism; and sexting with a participant. 
· Any type of grooming behavior is prohibited. 
· Prohibited forms of physical abuse include punching, beating, biting, striking, choking, slapping, or intentionally hitting a participant with objects or sports equipment; providing alcohol to a participant under legal drinking age; providing illegal drugs or non-prescribed medications to any participant; encouraging or permitting a participant to return to play after injury or sickness prematurely without clearance of a medical professional; prescribing dieting or other weight control methods for humiliation purposes; isolating a participant in a confined space; forcing participant to assume a painful stance or position for no athletic purpose; withholding, or denying adequate hydration, nutrition medical attention, or sleep. 
· Prohibited emotional abuse includes a pattern of verbally attacking a participant personally such as calling them worthless, fat or disgusting; physically aggressive behaviors such as throwing or hitting objects; and ignoring a participant for extended periods of time or excluding them from practice. 
· Bullying includes an intentional, persistent, or repeated pattern of committing or willfully tolerating (e.g., Desert Scouts Representative not preventing) physical, nonphysical, or cyber bullying behaviors that are intended to cause fear, humiliation, physical harm in an attempt to socially exclude, diminish, or isolate another person emotionally, physically, or sexually. It is often not the Desert Scouts Representative, but instead, other participants who are the perpetrators of bullying. However, it is a violation if the Desert Scouts Representative knows or should have known of the bullying behavior but takes no action to intervene on behalf of the targeted participants. 
· Prohibited hazing includes any contact which is intimidating, humiliating, offensive or physically harmful. Hazing typically is an activity that serves as a condition for joining a team of being socially accepted by team members. 
· Two deep leadership is required where two adults (e.g., any combination of Desert Scouts Representative or parents) should be present at all times so that a minor participant can't be isolated with a single unrelated adult, except in the case of an emergency. 
 
 
· In special situations involving an adult such as car travel, overnight travel, locker rooms/changing areas, individual coach meetings, and individual training sessions, minors should always have another child buddy with them or a second adult within an observable and interruptible distance. 
· All electronic communications including email, texting, social media, etc. between the Desert Scouts Representative and a minor participant should be limited strictly to the legitimate activities of the organization. A parent/guardian of minor or another Desert Scouts Representative should be copied on all such communications. 
· Desert Scouts Representative and minor participants should not connect on social media outside of the organization’s official social media accounts. 
· Any overnight travel exposure should prohibit adults spending the night in the same room as an unrelated minor participant; require grouping of participants of the same sex and age group in rooms; and provide adequate oversight with a same-sex chaperone for each group. 
· Take off/pick up of athletes by Desert Scouts Representative should be strongly discouraged because of the difficulty in limiting one-on-one contact. Reporting Suspicions of Child Sexual or Physical Abuse and Other Forms of Abuse Federal or state law may require any adult Desert Scouts Representative who has a suspicion of child sexual or physical abuse to independently report such suspicion directly to law enforcement within 24 hours. Failure to report may be a punishable offense. In addition, the adult Desert Scouts Representative should report the suspicion within 24 hours to the appropriate organization official and the official should also report to law enforcement within 24 hours if there is suspicion that child sexual or physical abuse has been committed. The organization should allow law enforcement to handle the investigation and the suspected Desert Scouts Representative should be immediately suspended or reassigned to alternative duties that don't involve access to youth pending the outcome of the investigation. Organization officials should not comment on the allegation or police investigation until it has been concluded. Desert Scouts Representatives should also report prohibited misconduct other than child sexual and physical abuse to the appropriate organization official and the organization can investigate and decide what types of sanctions, if any, are appropriate. The organization is prohibited from retaliating in any way against an Desert Scouts Representative who makes a good faith report of a suspicion of any form of misconduct. 
 
Child Abuse Training for Minors 
 
The Safe Sport Act requires sports organizations to provide minor training on preventing and reporting of child abuse. Our organization should distribute the following documents: Minor Training (Ages 4-12) and/or Minor Training (Ages 13-17) or a similar document from another source to each parent with a strong recommendation that each parent should review this document with their minor child.

Please refer to this program if more details are needed on the following issues: Safe Sport Act Requirements; abuse and misconduct definitions; social media; email; text, and instant messaging; locker rooms and changing areas; travel; reporting misconduct; what to do after reporting to law enforcement; responding to misconduct and policy violations; whistleblower protection; dealing with the media; screening volunteers; and administration of criminal background checks. 
 
Communication of Information The information in this risk management program should be communicated by pre-season Desert Scouts Representative meeting and/or by distribution of this document to all paid and volunteer Desert Scouts Representative(s) with evidence thereof retained for at least 15 years. Desert Scouts organization has adopted this program and incorporated it into our written policies and procedures. 
 
Reporting Harm to Minors

  • All Authorized Adults must report suspected child abuse to their Desert Scouts™ contact or supervisor. Desert Scouts™ Representatives must promptly report any such incidents to the Director of Human Resources (humanresources@desertscouts.net, as well as reach out to Local Law Enforcement.
  • If a Minor is any immediate danger, always call 911 immediately.

 Refund Policies: 
Written refund requests must be submitted by the Desert Scouts Representative. Written/Emailed request must be submitted within 30 days of original Desert Scouts™ platform registration date. Only written/emailed requests will be processed. 
 
Submitted Refund Requests that: 

  • Are requested after any Trainings / Certification Courses are already started by the Representative, are not eligible for a licensing fee or insurance fee refund.
  • Are made via debit/credit card, are returned to the original card used upon payment; returns to debit/credit card can be processed up to 30 days of original payment date. All other forms of eligible refunds are made by check.
  • Are made for delivered Training / Certification Courses / Certifications, and / or other course materials; are not eligible for a refund.
  • All DENIED refunds may maintain a credit on their account for up to (1) one year from the date of the original payment. Credit memos are available upon request, and these refunds can be applied to re-enter the Desert Scouts program with prior written consent from an Desert Scouts Official Operations Team Representative. Not all Denied refunds are approved for further credit.

Representative Refunds / Agreement Sale 

As a Representative of the Desert Scouts™ Network / Platform, Representatives are eligible to submit a request to sell/transfer area to a new Representative. This approval is at the sole discretion of an official Desert Scouts officer, and requires a 50% transfer / sale fee on the territory purchase price. In the event that the area is sold, the Representative will receive 50% of the sale price. 
Representative No Shows or Non-Completion of Trainings/Courses: 

  • Representatives who fail to attend any meetings/trainings/courses within the first 30 days, without notifying Desert Scouts for any given reason, are not eligible for a refund.
Online Cancellations & Refunds:

  • Representatives who make online purchases occasionally change their mind for one reason or another. A courtesy one-day (1-day) cooling-off period applies to Online Enrollments. For consideration: 
  • Representatives MUST notify Desert Scouts™ of their desire to cancel IN WRITING / EMAIL within 24-hours of placing the online order. If they change their mind during this one-day period, AND have NOT accessed any portion of the trainings/courses, they may be eligible for a full refund by submitting a written request to cancel/refund to: support@desertscouts.net
  • Representatives that have accessed, downloaded, or copied any of the Desert Scouts™ proprietary information / digital content in any way, immediately waive their right to a refund.  
  • No refund will be given if Desert Scouts™ has reason to believe that an individual has viewed/copied any of the content they have purchased. 
  • Refunds will not be issued if a user is “unable to access the content” on the Desert Scouts online platform, and does not submit a request for assistance with regard to any issues with access to the Desert Scouts Platform.
  • Technical Requirements should be reviewed before purchase. All users must possess the technical knowhow and equipment to access the platform.

 LICENSING TERMS (FRANCHISE)
 Licensed Territories / Licensed Territory Transfers:

   
 An DESERT SCOUTS LICENSED REPRESENTATIVE licenses territories in order to be authorized to use the Desert Scouts Platform and offer the Desert Scouts services. Desert Scouts Representatives will be required to maintain monthly territory fees to operate and qualify to be under the Desert Scouts Liability Insurance Policy. 

ROLE: MANAGING PARTNER, DISTRICT EVALUATOR, or REGIONAL / STATE EVALUATOR

Policies and Guidelines (Terms of Service) Requires a minimum of Ten (10) Paid Postal / Zip Codes to maintain MANAGING PARTNER, DISTRICT EVALUATOR, or REGIONAL / STATE EVALUATOR Licensing Terms. Any MANAGING PARTNER, DISTRICT EVALUATOR, or REGIONAL / STATE EVALUATOR Representative / Account not in compliance with Licensed Territory Terms, will be converted to a Single Licensed Evaluator Account, within 30 days, if the minimum required paid postal / zip codes are not paid. The account will then be put on “freeze” status, until all territory fees are paid, in order to maintain the required liability insurance coverage through the Desert Scouts insurance carrier. *The safety of our members is our main priority, and there are no exceptions to proper liability coverage. 

*Territory Terms may be subject to change under additional roles added to the platform, or in separate Agreements, which are approved by an authorized Desert Scouts agent.
 
Any REGIONAL (STATE) EVALUATOR Representative / Account that is converted over to a Single Licensed Evaluator Account and in “freeze” status, will need prior authorization from an authorized Desert Scouts agent, in order to be put in “active” status, and be authorized to reinstate the Representative account back to a REGIONAL (STATE) EVALUATOR role. Any questions / concerns regarding this, may be directed to: support@desertscouts.net

MANAGING PARTNER, DISTRICT EVALUATOR, or REGIONAL / STATE EVALUATOR: GUIDELINES / SCOPE OF WORK 

  • Will be expected to participate in a Mandatory Monthly Meetings with Desert Scouts™ Leadership, in order to continue the growth of their areas of the country / world, provide feedback, collaborate and assist with current and new implementation of programs, platform features, partnerships, joint venture relationships, which will help provide everyone with a positive and constructive open line of communication for organization and growth worldwide.
  • Will be expected to hold Mandatory Monthly Meetings with the Representatives in their respective States. These dates will be shared in the calendar feature on the Representatives dashboard / profile page. These can either be done as a state-wide Zoom™, or individual check-ins. Desert Scouts Leadership will be made available to assist with these meetings in the event that they are needed.
  • Will be expected to monitor progress of their respective territory, answer any questions that their Representatives may have, and to provide platform-wide updates to their team.
  • Will be expected to become B.A.S.E. Certified, Strength and Conditioning Certified, and be Certified in every sports-specific certification and training program that is offered by Desert Scouts™ for their selected SPORT.
  • Will be expected to be knowledgeable and up to date on all new Desert Scouts™ initiatives. Oversee the operations of their territory, and be able to answer all questions that their Representatives may have.
  • Will be expected to oversee Initial Athlete Contact reports and Athlete Event reports, within their territories.
  • Will be expected to monitor upcoming/current events, camps, or clinics in their territory. *ALL Evaluators running events, camps, and clinics with the B.A.S.E. Biomechanics portion of Assessment must be B.A.S.E. certified.

LICENSED INDIVIDUAL or ORGANIZATIONAL/FACILITY B.A.S.E. | STRENGTH AND CONDITIONING | SPORTS PERFORMANCE EVALUATORS: GUIDELINES / SCOPE OF WORK 

  • Will be expected to become B.A.S.E. Certified, Strength and Conditioning Certified, and be Certified in every sports-specific certification and training program that is offered by Desert Scouts™ for their selected SPORT, if applicable.
  • Will be expected to make themselves available for zoom meetings to assist in meeting, negotiating, and finalizing partnerships and joint venture agreements in their territory.
  • Will be expected to be knowledgeable and up to date on all new Desert Scouts™ initiatives. Oversee the operations of their territory, and be able to answer all questions that their Athletes, Parents, Guardians may have, and provide assistance to them related to the Desert Scouts Services that they offer.
 
  • Will be expected to make themselves available and run events, camps, or clinics for athletes in their territory. *ALL Evaluators running events, camps, and clinics with the B.A.S.E. Biomechanics portion of Assessment must be B.A.S.E. certified. 
  • Will be expected to follow the Standard Desert Scouts Evaluator Procedures found in the Desert Scouts Platform Certification Training, and Individual Desert Scouts Evaluator Trainings provided on the platform.
  • Will be expected to meet with a MANAGING PARTNER, DISTRICT EVALUATOR, or REGIONAL / STATE EVALUATOR of their respective states, ONCE monthly for their Mandatory Monthly Meeting. If Evaluator is unable to attend said meeting, they are required to set up an individual meeting to be brought up to date. If there is not a current active MANAGING PARTNER, DISTRICT EVALUATOR, or REGIONAL / STATE EVALUATOR, and Authorized Desert Scouts agent will be available to them, to assist with regards to updates in their area.
  • Will be expected to follow all DDesert Scouts Policies and Terms and Conditions policies.
  • May be expected to perform additional responsibilities outside of this general guidelines / scope of work. In the event that these additional responsibilities do not directly contribute to the compensation in the original Representative Agreement, there will be an additional addendum added to the Representative Agreement with additional compensation agreed on by the Representative and an Authorized Desert Scouts agent.
  • Will be expected to follow the following “Initial Athlete Contact” guidelines / protocols below.

 Initial Athlete Contact: 

  • Initial Contact must be made with an athlete/parent/legal guardian, by their evaluator within their first 48 hours on the platform. The initial meeting with an athlete will occur after they have booked for their Initial B.A.S.E.™ Assessment and/or Athlete Performance Assessment (Ex: On-Field, On-Court, On-Ice Assessment) within the first 30 days. (Athletes cannot participate in testing, strength and conditioning programming, performance assessments or training prior to receiving the Desert Scouts B.A.S.E. Assessments / Desert Scouts Corrective Measures programming. *All assessment data/scores must be entered exclusively on the Desert Scouts Platform
  • An athlete who has been assigned to an Athlete Evaluator / Desert Scouts Network for more than seven (7) days, without an Initial Contact or Event/Assessment booking, will be transferred to the next nearest Certified Evaluator.
  • The expectation at Desert Scouts™ is that every athlete has a great experience with transparent and honest communication. If the Evaluator cannot reach out to the athlete/parent/guardian within 48 hours, must notify their State/Regional Evaluator, so that they can assist immediately. Multiple violations with regards to lack of communication may result in the termination of the Representative, their Representative Agreement, and voids all return policies included in this document.
  • Each Athlete should have their first B.A.S.E. Assessment, Strength and Conditioning Programming Assignment, and/or Athlete Performance Assessment completed, with scores and feedback within their first 30 days on the platform.

 Associate Evaluator Guidelines:

  • Must make sure that Initial Athlete Contact with athletes has been made within their first 72 hours on the platform. Athlete should be booked within the first thirty (30) days, and receive their B.A.S.E. Assessment and Athlete Performance Assessment results within their first (30) days on the platform.
  •  
  • All Associate Evaluators must onboard an initial 20-30 Premium Athletes, or 40-60 B.A.S.E. Athletes. A Licensed B.A.S.E. Certified Evaluator will manage/run the camp of onboarded Premium or B.A.S.E. Athletes in order to allow the Associate Evaluator to get trained and certified to do Desert Scouts Assessments on their own, on the Desert Scouts™ platform. The Licensed B.A.S.E. Certified Evaluator will manage/run the camp, and the Associate Evaluator will assist with this camp. Both Desert Scouts Representatives will be compensated based on the Desert Scouts Associate Evaluator Compensation Outline. 
  •  
  • WHEN holding camps or clinics, or participating in camps and clinics, all evaluators must be B.A.S.E. certified in order to conduct the Biomechanics portion of the B.A.S.E. Assessment.
  •  
  • Evaluators will be asked to meet with State / Regional Evaluators of their respective states ONCE monthly for their Mandatory Monthly Meeting. If an Evaluator is unable to attend said meeting, they are required to set up an individual meeting to be brought up to date. 
  • All Evaluators will be expected to follow all Athlete Facing Guidelines, Attire, and Equipment policies as well.
  • Violating the Policies and Terms and Conditions of Desert Scouts™ may result in Representatives termination.
  •  
Camp and Clinic Rules and Guidelines:

Camps or Clinics:
When running camps or clinics, all Representatives who are handling the B.A.S.E. Assessments (Biomechanics) portion of the camp must be representatives of Desert Scouts AND be B.A.S.E. Certified. 
 
Training Programs and Certifications/ Continuing Education: 
  • Upon entrance into the Desert Scouts™ Platform, all Representatives who have licensed their territories in their respective sport, will be provided with the appropriate Desert Scouts™ Trainings that are currently available, in order to go through their respective Certification Trainings.
  • During the first 180 days of being on the Desert Scouts™ platform, Desert Scouts Evaluators will be required to take all of the B.A.S.E., Strength and Conditioning and Sport Specific Certification Trainings which apply to their role / territory. This will ensure that the Desert Scouts Platform maintains consistency. In the event that an Desert Scouts Evaluator is not able to complete their training, they are required to notify Desert Scouts Leadership, in order to make proper accommodations moving forward. In the event that this may occur, we ask that Desert Scouts Leadership is notified. Please reach out to support@desertscouts.net
  • Following the first full year on the platform, each evaluator and scout will be expected to take additional continuing education courses to maintain their standing with current sports-specific content.
  • After the first Twelve (12) Months of being on the Desert Scouts™ platform, Desert Scouts Representatives will be required to take quarterly B.A.S.E., Strength and Conditioning, and Performance Assessment continuing education courses for the price of $100 Each. This will ensure that the Desert Scouts Platform maintains consistency.
Training Expectations: 
-   B.A.S.E. TRAINING (CERTIFIED WITHIN FIRST 120 DAYS OF REGISTRATION) 
-   STRENGTH AND CONDITIONING CERTIFICATON TRAINING (WITHIN 180 DAYS OF REGISTRATION) 
-   ONE (1) SPORT SPECIFIC CERTIFICATION (1 PER QUARTER) *IF APPLICABLE 
 
Outreach Expectations: 
 
Representatives Are Expected to Reach Out to Local Contacts, Facilities, Organizations Within 90 Days of Registration. This Will Facilitate The Desert Scouts Partnership / Joint Venture Team To Assist In Building Athlete Counts For Evaluators.

 B.A.S.E. ASSESSMENT TRAINING AND CERTIFICATION 

  Evaluator Expectations 
·         Show all instructions/demonstrations for each test, including coaching of proper form/technique 
·         An Athlete Evaluator should show their judgment of which trials are valid / not valid, and have them redo invalid trials if needed 
·         Verbalize all scores and measurements on the video for every test 

Video Expectations 

·         Video should be filmed horizontally 
·         Video should be shown from the proper angle, to allow visualization of the necessary components 
·         Video should show the measurement process 
·         Video should show the entire body, including the feet 

Measurement Expectations 

·         Distance measurements should be in the metric scale 
·         Athleticism tests should be measured to the nearest ½ cm (i.e. 71.5 cm) 
·         Sequence tests should be measured to the nearest cm (i.e. 8.37 meters). 
·         Speed and agility tests should be measured to the nearest 1/100th of a second (i.e. 6.92 seconds). 

Video Submission Instructions 

Athlete Evaluators should be saving their assessment videos as an MP4 file format, and uploading their videos, along with a picture of their score sheet to app.desertscouts.net, from their Desert Scouts Dashboard. Athlete Evaluators will only be allowed to submit one (1) video until they receive feedback from the Desert Scouts Sports Medicine Team. 
 
If any Athlete Evaluator has trouble uploading the video directly to the platform, they may create a YouTube video or playlist as a last resort, and post the YouTube video link from their Desert Scouts Dashboard, on app.desertscouts.net instead. *If videos are posted on YouTube, please be sure that the video privacy is set to “unlisted”, rather than public or private access. 

If an Athlete Evaluator’s assessment videos contain numerous mistakes and there is insufficient progress shown between assessments despite feedback/coaching being provided, they will be asked to repeat the B.A.S.E. Assessment Certification Training prior to submitting any additional videos. This will be enforced following the second or third failed attempt, depending on the amount of progress shown. 

Once certified, Athlete Evaluators will be required to attend (4) continuing education courses over the course of each year, and pass the subsequent quizzes to retain their certification.
